Town of Woodland Special Called Meeting to Discuss the Well Project with

Special Guests: Blaine Humphrey (Rivers & Associates), Randy Beale (Mayor elect), and Ricky Morris (Commissioner elect)

Call to Order: Mayor Manuel called the meeting to order at 6:00 pm.

Blaine Humphrey explained that change order #2 was due to the fact that Dominion required mounting the meter base on a separate rack. Their blue book did not show this requirement therefore the contractor was unaware and it had to be redone. This cost extra time and money.

A.C. Schultes submitted several letters requesting additional time for delays, but Rivers and Associates along with the Town of Woodland did not agree with these delays. In response to A.C. Schultes request, Blaine Humphrey responded with a letter stating we will not allow 188 days of extension, but we do agree upon 14 days.

Blaine Humphrey told the board how much retainage there is and suggested the town withhold $10,000 from payment #7. He said the retainage we have will cover out of pocket requests through the end of October. Commissioner Christison asked Mr. Humphrey if it would be best to wait until the last payment or even the next payment to withhold the money so that A.C. Schultes does not stop work on the well. Mr. Humphrey said that we are within our rights to withhold the money and if A.C. Schultes quits the job, we can go after their bond and use their bond to get another company to finish the job.

Marshall Lassiter told the board that all the lab samples that A.C. Schultes has sent off so far have not passed, and he said we will not accept this well until we get good samples. Mr. Lassiter also informed the board that a man from the state will be here on November 27, 2019 to look at the well. Mr. Lassiter told the gentleman that the well was not complete, but he said he is still coming.

After this discussion, the board agreed to withhold $10,000 from payment #7. Donielle McDermott will type a letter of explanation to include with their payment.

Adjourn: At 7:05 pm, Commissioner Christison made a motion to adjourn the meeting. Commissioner Liverman seconded and the motion carried.
